DECEMBER 5, 2005

 

The Town of Marcy Zoning Board of Appeals held a Regular Meeting on Monday, December 5, 2005 at 7:00PM at the Marcy Municipal Building, 8801 Paul Becker Road, Marcy, New York.

Zoning Board of Appeals Chairman Carson E. Sorrell called the Regular Meeting to order with the Pledge of Allegiance at 7:00PM.

 

Zoning Board of Appeals Member Frank J. Pinnisi made a motion to dispense with the reading of the

November 7, 2005 Zoning Board of Appeals Minutes; seconded by Zoning Board of Appeals Member Paul

M. Evans.

All Members Voting: Aye

Zoning Board of Appeals Chairman Carson E. Sorrell asked if there were any corrections.

Zoning Board of Appeals Member Lant C. Wagner made a motion to approve the November 7, 2005 Zoning Board of Appeals Minutes as written; seconded by Zoning Board of Appeals Member Paul M. Evans.

Mr. Amodic attended the November 14, 2005 Review Panel Meeting. Mr. Amodic represents Lonestar Construction who has recently constructed another home in Buckland Estates. The home has been constructed and it is not where the building permit application shows it should be. The home is approximately 6" off.

A Residential 20,000 District requires a 50’ front yard setback, therefore an Area Variance will be required since it was found that the home is 49 ½’ from the front yard property line.

Unfortunately, Mr. Amodic was not present for the Meeting.

Zoning Board of Appeals Members requested that Codes Enforcement Officer George W. Russell be contacted to issue a Stop Work Order.


 

JEFF PECK, 7620 NYS Route 291

Use Variance

Site Plan Review

Appeal Number 2005-00-00

Mr. Peck attended the November 14, 2005 Review Panel Meeting. Mr. Peck has recently subdivided his property and constructed a home. Mr. Peck would now like to conduct business at this location.

Mr. Peck would like to open a showroom for his window business as well as lease a portion of the building. Mr. Peck would also like to sell products from this location.

Mr. Peck would like to have a hot tub showroom and sell Adirondack furniture, picnic tables, gazebos, etc.

Mr. Peck currently does business out of his home, selling windows, which is a full-time job. Mr. Peck has sub-contractors as well.

A Use Variance will be required in order to conduct this type of business in a Residential 20,000 District.

Mr. Peck was not present for the Meeting.

 

 

OTHER BUSINESS

Zoning Board of Appeals Member Frank J. Pinnisi will attend the December 8, 2005 Town Board Meeting.

Zoning Board of Appeals Chairman Carson E. Sorrell will attend the January 2006 Town Board Meeting.

Zoning Board of Appeals Chairman Carson E. Sorrell noted that at John Couzelis attended a Review Panel

and questioned if he could construct a home on a pre-existing non-conforming lot.

Zoning Board of Appeals Chairman Carson E. Sorrell stated that he has contacted the Department of State who has their Legal Department reviewing. The Department of State was not sure if Mr. Couzelis would need to apply for an Area Variance. Zoning Board of Appeals Chairman Carson E. Sorrell noted that 150’ of frontage and 40,000 square feet are required in an Agricultural District. Zoning Board of Appeals Members stated that they believe an Area Variance will be required.

Zoning Board of Appeals Chairman Carson E. Sorrell distributed a letter issued by Town Attorney Randal B. Caldwell on October 11, 2004 concerning Use Variances. Zoning Board of Appeals Chairman Carson E. Sorrell stated that he thought it was important that the Zoning Board of Appeals Members review the memo once again.

 

Zoning Board of Appeals Member Frank J. Pinnisi made a motion to establish the following dates as Regular

Meeting Dates of the Zoning Board of Appeals for 2006; seconded by Zoning Board of Appeals Member

Paul M. Evans.

The next Zoning Board of Appeals Meeting is scheduled for Monday, January 9, 2006.

Zoning Board of Appeals Members stated that they would like to recommend that the Town Board reappoint Frank J. Pinnisi as a Zoning Board of Appeals Member.

Having no further business, Zoning Board of Appeals Member Paul M. Evans made a motion to adjourn the meeting at 7:35PM; seconded by Zoning Board of Appeals Member Carl A. Annese.
